A binding contract is established only when both parties have signed a written agreement that specifies the scope of work, materials, price, and project timeline. Project start dates are scheduled based on permit approval, material availability, and our current workload. We will provide a projected start date in the written contract, but this date may change due to factors outside our control, including weather, permit processing delays, or material supply issues.
If you need to cancel or reschedule a project, please contact us as soon as possible. Specific cancellation terms, including any applicable deposit refund policies, are outlined in your written contract.
We reserve the right to cancel or reschedule work due to unsafe weather conditions, site access issues, or other circumstances that make it impractical or unsafe to proceed.
Payment terms are specified in the written contract for each project. In general, we require a deposit at contract signing, progress payments at agreed milestones, and a final payment upon project completion and customer walkthrough.
California law limits the deposit a licensed contractor may collect before work begins. We comply with all applicable California Contractors State License Board regulations on deposits and progress payments.
Past-due balances may be subject to interest charges as specified in the written contract. We reserve the right to suspend work on a project if payment obligations are not met.
Where required by local law, Highland Deck and Fence will obtain the necessary building permits before construction begins. Permit fees are the responsibility of the customer and will be included in the project estimate.
The customer is responsible for obtaining any required HOA approvals before work begins. We will assist in preparing materials for HOA submission, but we cannot guarantee HOA approval. Delays caused by HOA review are outside our control and may affect the project timeline.
We stand behind the quality of our workmanship. Specific warranty terms for labor are outlined in each written contract.
Materials used in your project carry the manufacturer's warranty where applicable. We do not extend or modify manufacturer warranties. Warranty claims for materials must be submitted through the manufacturer's process.
Warranties do not cover damage caused by misuse, abuse, neglect, failure to follow maintenance recommendations, acts of nature, or modifications made by anyone other than Highland Deck and Fence.
To the fullest extent permitted by applicable law, Highland Deck and Fence and its owners, employees, and subcontractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to any project or services provided, even if advised of the possibility of such damages.
Our total liability to you for any claim related to a project shall not exceed the total amount paid by you to us for that specific project. This limitation applies whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory.
